5.1 ta bisa lo sigiente:

“ EVENT OF REVERSION.

Coastals rights  to the Leasehold (Erfpacht) shall  terminate and revert at NO cost to the Government and all of Coastal’s obligations under the Leasehold, including but not limited to the obligation to make rental payments shall terminate, after one year’s prior written notice by Coastal to the Government that Coastal is permanently ceasing refining operations or at the conclusion of thirty-six consecutive calendar months during wich there are NO refining operations at the Refinery.
Upon the occurrence of either of these events of  reversion, Coastal has the obligation to dismantle and remove the facilities and improvements located on the Leasehold from Aruba at its own cost and expense, within a reasonable period, not to exceed three years. Following the event of reversion. Etc.

5.2  CESSATION OF OPERATION PRIOR TO 2006.

Should an event of reversion as described in section 5.1 occur prior to Januari 1, 2006,  the Government may at its option elect within 60 days of said event of reversion, being for this purpose (i) the date of written notice of termination or (ii) the date of conclucion of the thirty-six months term during which there are No refining operations at the Refinery, to seek another operator for the Refinery or operate the Refinery itself.  Upon exercise of the election, the Government shall have two (2) calendar years to conclude an agreement with a third party with respect to the continued  operation of the Refinery or to formally elect to operate  the Refinery itself.

In either case , Coastal’s obligation under Section 5.1 to dismantle and remove the improvements and equipment shall be tolled  for the said two(2) calendar years.  Should such agreements be concluded with a third party or should the Government elect to operate the Refinery, the Government shall purchase the improvements and equipment from Coastal no later than the conclusion  of the said two(2) calendar years at the fair market value of said improvements and equipment as determined  by  3 experts,  etc.

Kiko e dos articulonan ta bisa:

3. Despues ainda 2 ana dentro di cual Gobierno por busca un operatornobo of cumpra e refineria esta e parti cu Coastal, El paso y Valero a inverti,

4. Y si ainda esaki no a duna fruta Coastal/El Paso/Valero tin 3 ana pa desmantela.

Un vez mas esaki ta un mechanismo cu  ta ensera cu pa e periodo

8/9ana maximalmente dentro di cual e refineria ainda legalmente ta den man di VALERO y nada por worde hasi riba tereno y den haf di San Nicolas.  Hasta e periodo aki ta ensera dos periodo di gobernacion completo.

Pesey PPA ta considera cu majoria partido politico presenta na e forum di SNAPP ta papia  riba  idea cu NO por worde ejecuta pa hopi ana e.o. e mudamento di Containerhaven pa San Nicolas.

Pesey un vez mas PPA ta keda riba nos vision pa San Nicolas  “the Agenda for San Nicolas y San Nicolas a Caribbean City”.

Un vision cu ta ensera un desaroyo primeramente hasciendo uso di e historia Caribense di San Nicolas.

Naturalmente mester hasi lo maximo di e refineria keda habri, pero si encaso esaki No por mester kana e caminda y e mecanismo cu ta un compromiso entre e refineria y pais Aruba.
